Terms of Service

1. Your account

You must be at least 18 and legally able to enter into an agreement to use the Service. If you use it for an organization, you represent that you have authority to bind that organization, and "you" includes that organization. Provide accurate account information, keep your sign-in credentials secure, and promptly report suspected unauthorized access to admin@artifables.com. You are responsible for your use of the account and for people you authorize to use it.

2. Using the Service

We grant you a limited, non-exclusive, non-transferable right to use the Service for your personal or business purposes, subject to these Terms. You must not:

• Use the Service to break the law, defraud others, harass people, or facilitate harm;
• Submit or generate content that infringes intellectual property, privacy, or other rights;
• Distribute malware, send spam, or access systems or accounts without authorization;
• Bypass security controls or usage limits, interfere with the Service, or access another user's data; or
• Sell or sublicense access to the Service without our written permission.

3. Your content and AI output

You retain your rights in messages, files, and other materials you submit ("Input"). As between you and us, you own the output generated for you ("Output") to the extent permitted by law. We assign to you any rights we may have in that Output. AI output may not qualify for intellectual property protection, may resemble other users' output, and may include material subject to third-party rights. These Terms do not give you rights in someone else's material.

You give us permission to host, process, transmit, and display your Input and Output only as needed to provide and maintain the Service, comply with law, and keep the Service secure. You must have the rights and permissions needed to submit your Input and authorize its use. Our handling of personal information is described in our Privacy Policy. We do not use your Input or Output to train machine learning models.

We and our licensors retain ownership of the Service's software, branding, and other materials, excluding your Input and Output. Third-party and open-source components remain subject to their applicable licenses.

4. AI limitations and agent actions

AI can produce inaccurate, incomplete, offensive, or misleading results, even when they sound confident. Review Output before relying on, publishing, or using it. The Service is not a substitute for professional medical, legal, financial, or other advice, and must not be used for emergencies or safety-critical decisions.

Your agent can use tools, run code, modify files, access connected services, and carry out scheduled tasks based on your instructions and permissions. These actions may have real-world consequences and may not be reversible. Grant only the access you intend, review important actions and results, and keep separate copies of important files. We do not guarantee that every action will require a separate confirmation or that data can always be recovered.

5. Third-party services

Your agent runs on AI models from other companies. By using the Service, you agree that we send them the data needed to carry out each request, which can include:

• your messages and conversation history;
• files, photos, links, and text you attach or share to the agent, including from the Arty share sheet;
• audio you record for dictation;
• calendar events on your phone that you ask the agent to read;
• data from accounts you connect, such as Google or Microsoft, when the agent uses them; and
• notes the agent has saved about you so it can remember.

These providers are Anthropic (Claude models), OpenAI (ChatGPT models, dictation, image generation, and search indexing for the Assistant), Google (Gemini models, the Assistant and background tasks, Read aloud, and image generation), and Brave (web search queries). Section 5 of our Privacy Policy lists what each one receives and how each protects it. Under their terms with us, they may use your data only to provide their service, and Anthropic, OpenAI, and Google may not train their models on it. If you connect your own ChatGPT or Claude plan, that provider's terms with you also apply. Do not use the Service if you do not want this data sent to these providers.

The Service also relies on third-party hosting and other tools. If you connect an outside account, you authorize us to access it as needed to carry out your requests. Your use of third-party services is also subject to their terms, policies, and charges. You are responsible for having permission to connect and use those accounts. We do not control third-party services or guarantee their availability, accuracy, or continued compatibility.

6. Fees and changes to the Service

Any paid offering will disclose its price, billing frequency, usage limits, cancellation method, and refund terms before you agree to pay. Recurring charges require your agreement to the applicable subscription terms. We will not convert free access into paid access without your agreement. Nothing in these Terms limits any refund or cancellation rights required by law.

Features, models, and limits may change. The Service may be unavailable during maintenance, outages, or third-party disruptions. We will give reasonable advance notice of changes that materially reduce a paid service or discontinue the Service, unless urgent security or legal reasons prevent notice. Any applicable paid-service terms and mandatory consumer rights continue to apply.

7. Ending your use

You may stop using the Service at any time. To close your account, contact admin@artifables.com. If you have a paid subscription, follow its cancellation terms as well. Uninstalling Arty does not close your account or cancel a subscription.

We may suspend or end access if you materially violate these Terms, create a security or legal risk, fail to pay agreed fees, or if we discontinue the Service. Where reasonably possible, we will notify you and give you an opportunity to address the problem and retrieve your content. We may act immediately when needed to prevent harm or comply with law.

Closing your account may permanently delete your dedicated server, files, conversations, and agent memory as described in the Privacy Policy. Save anything you need first. The provisions on ownership, payment obligations already incurred, disclaimers, liability, and disputes survive termination.

8. Disclaimers

To the fullest extent permitted by law, the Service and Output are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure, or that Output will be accurate or suitable for your needs. Statutory warranties that cannot lawfully be excluded still apply.

9. Limits on liability

To the fullest extent permitted by law, AiWondertales LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, data, or goodwill arising from your use of the Service. Our total liability for claims arising out of or relating to the Service or these Terms will not exceed the greater of US $100 or the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by our negligence, or any liability that cannot be excluded or limited by law. Nothing in these Terms waives your non-waivable consumer rights.

10. Disputes and general terms

North Carolina law governs these Terms, without regard to conflict-of-law rules, except where the mandatory laws of your place of residence apply. These Terms do not require arbitration or prevent you from bringing a claim in a court available to you under applicable law. For help resolving a concern, contact admin@artifables.com.

These Terms, together with any separate terms you expressly accept for a paid offering, are the entire agreement between you and us about the Service. If a provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.

11. Changes to these Terms

We may update these Terms. We will post the revised version here with an updated date and notify account holders by email or through the Service before material changes take effect. Changes will apply prospectively. Continuing to use the Service after the effective date means you accept the revised Terms, except where applicable law requires express consent, which we will request. If you disagree, stop using the Service and contact us to close your account.
